Terms of Use

Last updated: 7 October 2026

1. About these Terms

These Terms of Use apply when you access or use NestPro NZ, including our website, marketplace, listings, profiles, applications, messaging, and related services.

By creating an account or using NestPro NZ, you agree to these Terms. If you do not agree to them, you should not use the service.

NestPro NZ is operated in New Zealand and is intended for users aged 18 years and over.

2. What NestPro NZ provides

NestPro NZ is an online marketplace designed to help people find rooms, flatmates, and long-term shared-living opportunities in New Zealand, with a focus on working adults and professional lifestyles.

NestPro NZ provides tools that allow users to create profiles, publish listings, search listings, submit applications, communicate with other users, and use related marketplace features.

Unless we expressly state otherwise, NestPro NZ is not a landlord, tenant, property owner, property manager, real estate agent, letting agent, accommodation provider, or party to an agreement made between users.

3. User accounts

You must be at least 18 years old to create or use a NestPro NZ account.

You must provide information that is accurate and not misleading and keep relevant account and profile information reasonably up to date.

You are responsible for protecting your account credentials and for activity carried out through your account. You must not allow another person to impersonate you or use your account in a misleading or unauthorised way.

You should contact us promptly if you believe your account has been accessed or used without permission.

4. Listings and user information

Users are responsible for the accuracy and legality of the information, photos, descriptions, preferences, and other content they provide through NestPro NZ.

If you publish a listing, you must have a legitimate basis for offering the accommodation and must not knowingly provide false, misleading, deceptive, or materially incomplete information.

Listing photos and other uploaded content must be content you are entitled to use and must not unlawfully infringe another person's rights.

NestPro NZ may remove, restrict, or require changes to content that we reasonably believe breaches these Terms, applicable law, another person's rights, or the safety and integrity of the marketplace.

5. Applications and acceptance

NestPro NZ allows users to submit and respond to applications for shared-living opportunities.

An application status shown by NestPro NZ, including an "accepted" status, records a marketplace decision between users. It does not by itself create a tenancy, flatmate agreement, licence, lease, or other accommodation contract.

Users are responsible for deciding whether to enter into a separate accommodation agreement and for understanding which laws apply to their particular living arrangement.

NestPro NZ does not provide legal advice and does not determine whether a particular arrangement is a residential tenancy, boarding-house tenancy, flatmate arrangement, licence, or other legal arrangement.

6. User checks and decisions

Users are responsible for making their own enquiries and decisions before entering a shared-living arrangement.

This may include checking the identity of the other person, viewing the property, confirming who is entitled to offer the accommodation, discussing household expectations, understanding payment arrangements, and obtaining appropriate advice or a written agreement where needed.

You should not send money or provide sensitive information merely because another person has contacted you through NestPro NZ.

7. Payments and accommodation arrangements

Unless NestPro NZ expressly introduces and identifies a payment service in the future, accommodation payments, rent, board, deposits, bonds, utilities, and other financial arrangements are made outside NestPro NZ and directly between the relevant people.

Users are responsible for ensuring that any money requested, collected, lodged, refunded, or otherwise handled in connection with an accommodation arrangement complies with the law that applies to that arrangement.

8. Respectful and lawful use

You must use NestPro NZ lawfully and in a way that respects the rights and safety of other people.

You must not use NestPro NZ to:

  • commit or facilitate fraud, scams, or other unlawful acts;
  • threaten, harass, abuse, intimidate, or deliberately deceive another person;
  • impersonate another person or materially misrepresent your identity or authority;
  • publish content that is unlawful or that unlawfully infringes another person's rights;
  • distribute malware, interfere with the service, attempt unauthorised access, or misuse NestPro NZ systems;
  • scrape, harvest, or systematically collect user information without authorisation; or
  • use information obtained through NestPro NZ for an unrelated unlawful or abusive purpose.

9. Accommodation preferences and discrimination

Shared living can involve personal compatibility, household preferences, and different legal arrangements. Users are responsible for ensuring that their listings, decisions, and conduct comply with the Human Rights Act 1993 and any other applicable law.

New Zealand law contains rules prohibiting discrimination in accommodation as well as specific exceptions that may apply in some shared residential situations. Whether an exception applies depends on the circumstances.

NestPro NZ may apply its own marketplace standards and may remove content or restrict conduct that we reasonably consider discriminatory, abusive, harmful, or inconsistent with a safe and respectful marketplace, even where the legal position may depend on individual circumstances.

10. Messaging

NestPro NZ messaging is provided to help users communicate about genuine shared-living opportunities.

Users must not use messaging for spam, harassment, scams, unlawful solicitation, or unrelated commercial promotion.

We may access or review information where reasonably necessary to operate and secure the service, investigate a report or suspected misuse, respond to safety concerns, or comply with law, subject to our Privacy Statement and applicable privacy obligations.

11. AI Listing Assistant

NestPro NZ may provide AI-assisted tools to help users draft listing content.

AI-generated content may contain mistakes, unsuitable wording, or information that requires correction. The user remains responsible for reviewing the generated content and ensuring that anything published is accurate, lawful, and appropriate.

AI-generated content is provided as drafting assistance and should not be treated as legal, financial, property, or other professional advice.

12. Verification and trust features

NestPro NZ currently provides email verification and may introduce additional verification or trust features in the future.

A verification indicator, if provided, means only that the particular check described by NestPro NZ was completed. It must not be interpreted as a guarantee of a person's identity beyond that check, character, reliability, financial position, property rights, suitability, safety, or future conduct.

13. Reports, safety, and enforcement

Users may report suspected misuse, unsafe conduct, misleading listings, or other concerns to NestPro NZ.

We may investigate reports and take reasonable action, including requesting information, removing content, restricting features, suspending accounts, or disabling accounts.

NestPro NZ is not an emergency service. If you or another person is in immediate danger, contact the appropriate emergency service.

14. Intellectual property

NestPro NZ and its platform content, branding, design, software, and related materials are protected by applicable intellectual property laws, except for content owned by users or third parties.

You retain ownership of content you provide to NestPro NZ. You give NestPro NZ a non-exclusive permission to host, store, process, reproduce, display, and otherwise use that content to the extent reasonably necessary to operate, provide, secure, promote, and improve the NestPro NZ service.

This permission ends when the relevant content is deleted from our systems, except to the extent continued retention or use is reasonably required for legal, safety, operational, backup, or other lawful purposes.

15. Third-party services

NestPro NZ uses third-party technology and service providers, including services used for hosting, authentication, storage, email, maps, analytics, and AI-assisted features.

Some third-party features may also be subject to the relevant provider's terms or privacy practices.

16. Availability of the service

We aim to keep NestPro NZ available and reliable, but we do not guarantee that the service will always be available, uninterrupted, secure, or error-free.

Features may be changed, suspended, or discontinued where reasonably necessary for maintenance, security, legal, operational, or product reasons.

17. Marketplace risks and responsibility

NestPro NZ helps users discover and communicate with other people but does not control everything users say or do and cannot guarantee the accuracy of every listing, profile, message, or representation.

To the extent permitted by law, users are responsible for their own decisions, interactions, inspections, negotiations, and accommodation arrangements.

Nothing in these Terms excludes, restricts, or modifies any right or remedy that cannot lawfully be excluded, restricted, or modified under New Zealand law.

18. Suspension and account closure

You may request closure of your account by contacting NestPro NZ.

We may restrict, suspend, or close an account where reasonably necessary because of a breach of these Terms, suspected fraud or misuse, safety concerns, legal requirements, repeated harmful conduct, or risks to NestPro NZ or its users.

Personal information associated with account closure is handled in accordance with our Privacy Statement and applicable law.

19. Changes to these Terms

We may update these Terms when NestPro NZ, our services, or applicable requirements change.

The current version will be published on this page with its updated date. Where a change is significant, we may provide additional notice where appropriate.

20. New Zealand law

These Terms are governed by New Zealand law. Nothing in these Terms is intended to prevent a user from exercising rights they have under applicable New Zealand law.
